PLEASE READ THE ENTIRE MEMBERSHIP AGREEMENT BELOW
THE FOLLOWING DESCRIBES THE TERMS ON WHICH Splash-Wave.com OFFERS YOU ACCESS TO OUR SERVICES.
This User Agreement ("Agreement") is a binding contract between you and Splash-Wave.com and applies to your use of the Splash-Wave.com services and any related products available through Splash-Wave.com Internet Servers (collectively the "Service"). If you do not agree to be bound by the terms and conditions of this Agreement, please do not use or access our Services.
By clicking on the "Sign Up" button and participating in any program offered by Splash-Wave.com, you agree to be bound by all the terms of this Membership Agreement including the privacy statement.
Updates to This Agreement.
This Agreement may be modified by Splash-Wave.com from time to time, with or without notice. Member accepts any modification by using the Service after the modifications have become effective. If the Member objects to any modification, the Members sole remedy is termination of the Members account by contacting our support staff.
The Splash-Wave.com Service:
The user agrees not to operate hardware or software designed to bypass the systems developed by Splash-Wave.com for the benefit of all the users. Splash-Wave.com members are strictly prohibited from artificially accumulating credits to their account through the use of (but not limited to) any device, program, software or robot designed to auto click or alter the surfing environment in any way other than it's intended form of use.
Members are not permitted more than one Account. Signing up to more than one account could result in member termination and loss of all site credits, banner credits, text credits, and any cash in member account balance.
When an account is set-up, the user agrees to provide current and accurate information. User agrees that, that information can be used by Splash-Wave.com to make contact with the user. You also agree that by submitting this application you are subscribing to our affiliate newsletters and that you give us the right to send you email announcements. Any inaccurate information may result in the users account being closed.
Information given in registration will not be sold or given to any third party without the users written permission, unless required to by law. Users agree not to collect or harvest any users information that may be on our internet servers.
Websites NOT allowed at Splash-Wave.com
* Sites found to violate these terms will have their page removed and all credits assigned to the page will be forfeited.
* Adult, Racism, Warez, illegal or any other unsuitable websites are not allowed on our network. Members who post unsafe websites will have their pages removed and all credits assigned to the page will be lost.
* Framebreakers - Don't add them!
* Multiple and/or Full screen pop ups, Popup Rotators, Exit pop-ups, one time pop-ups or any other pop up that opens a new browser window. Don't even THINK about adding them! They will be deleted upon discovery and all credits assigned to them lost forever. One popup will be permitted as long as it does not interrupt surfing. This will be at the sole discretion of the admin.
* Redirected URLs (Sites which load a completely new Url from a site currently being viewed. This does not include tracking or shortened Urls.
* Rotators must contain either disclosed links or admin checkability. Currently, Trker (Hitsconnect) and Pageswirl are admin checkable. NO Rotators Within Rotators.
* Splash-Wave.com splash pages or index page.
* Sites attempting to initiate non-requested/malicious downloads including but not limited to adware/spyware
* Page not found errors / or incorrect URLs.
* Banners must display correctly; be of a 468 x 60 format (or close); match the URL content; and the URL must meet the above requirements.
* Google Adsense ads should not be shown within framed pages as per Google TOS. Please do not submit google adsense sites for your benefit.
* Sites must contain 100% english language.
* PaytoPromote Sites (PTP), are subject to Admin disgression.
* No HYIP (High Yeild Investment Program).
* Surfing Links in attempt to earn credits from another exchange.
* No Investment Auto Surf sites
* No Investment Manual Surf sites that follow the x% daily paid to surf type model
* All sites are subject to the approval and discretion of Admin. All modified rotators, trackers, or domain controlled sites must be resubmitted for admin approval. Failure to do so may result in the loss of your account.
Splash-Wave.com Credits
A " Splash-Wave.com Credit" (hereafter referred to as "credit") has no monetary cash value. Credits may be purchased, or earned by the member for using the Splash-Wave.com surfing module only.
Eligibility for Credits
Credits may be earned only in compliance with this agreement and other regulations posted on the Splash-Wave.com web site. In general, a credit may only be earned or used through our Splash-Wave.com software surfing module, or any other method that Splash-Wave.com creates and/or approves.
Guaranteed Visitors
A Guaranteed Visitor for purposes of this agreement shall be defined as "each time any Splash-Wave.com website or Splash-Wave.com software application redirects a user to another members web site URL". It is the members responsibility to make sure the provided URL is accessible. To be guaranteed a visitor the member must have one unused credit available and choose to trade that credit for a Guaranteed Visitor. Splash-Wave.com makes no claim as to when visits will be received by the user. Splash-Wave.com can not be held responsible for third party hit trackers that may not record hits accurately. Splash-Wave.com statistics are final. Hits are views and are not viewers/visitors. Some sites may be shown multiple times to users.
No member shall be required to pay any dues to maintain an active Splash-Wave.com registration. If the member chooses to participate in optional fee-based services, the membership fee must be paid in advance to maintain continuous service.
Direct Sales
When a new member links to our network from a members web site through the HTML or programming code which Splash-Wave.com provides the member, the referring members ID number will be logged. Should that visitor become a new paid member, the referring member will be eligable for a percentage of that direct sale based upon the percentage set forth by Splash-Wave.com. No member will receive any credit or bonuses for any referral.
LIABILITY
Splash-Wave.com, as well as its administrators, partners, and sponsors, can not be held responsible or liable for any damage or loss of information that may occur as a result of using Splash-Wave.com services. Members agree to use Splash-Wave.com services at their own risk. Splash-Wave.com advises the use of anti virus software when using any traffic exchange or otherwise surfing the internet.
Members have the right to cancel their Splash-Wave.com membership at any time. All existing referrals and/or credits and future earning potential through our affiliate program will be forfeited at the time of cancellation.
REFUND POLICY
Splash-Wave.com is in no way associated with PayPal, AlertPay, or any other payment processor, and merely uses them to process payments for such things as membership fees, paid advertising, and purchasing credits.
Furthermore, Splash-Wave.com will not be held responsible or liable for any problems, damages, or losses that may occur with regard to a member's direct association with PayPal, AlertPay (or other payment source) and any other aspects of their account. If any member cancels their Splash-Wave.com account, that member will be responsible for cancelling any upgrades or other subscriptions member may have with Splash-Wave.com through Paypal or Alertpay. Member MUST go to Paypal or Alertpay and cancel the subscription otherwise the monthly fees will continue. YOUR Paypal or Alertpay account is YOUR responsibility!
Splash-Wave.com will not issue any refunds for credits purchased or for failure to cancel services. Note: Splash-Wave.com only uses PayPal and Alertpay to pay out any commissions earned. If you do not have a PayPal or Alertpay account that receives payments from us then you may use the amount for upgrade or other purchases on the site.
Activity & Requirements
In order to be considered an active member you must log into your account at least once every 90 days. Failure to log in within a 365 day period can be grounds for your account to be deleted.
Your relationship to Splash-Wave.com
Your relationship to Splash-Wave.com is one of an independent contractor and/or customer. No employee-employer relationship is created by your use of the Service. You do not have any obligation to refer new members to the Splash-Wave.com Program. Splash-Wave.com HAS NO OBLIGATION TO OFFER THE SERVICE OR OTHER PROMOTIONS TO YOU.
While Splash-Wave.com may take measures to prevent offensive information, the user acknowledges that any content found on our servers may not be controlled by Splash-Wave.com, and Splash-Wave.com can not be held accountable for it. However, the user agrees not to use Splash-Wave.com to promote or advertise any of the following material. Pornographic, Links or banners to pornography, Adult Content, Explicit, Racial, Hate, Illegal, SPAM, Auto-Surf Software, or any other material that may be offensive, harmful, hurtful, illegal or unethical.
Users will conduct themselves in appropriate manner and will not manipulate any of the site to gain credit or access to unauthorised areas. Also, Splash-Wave.com does not allow the use of auto-surf software/hardware (etc.) to gain credits. Anyone caught using or distributing it will have their account terminated.
The user agrees not to hold Splash-Wave.com responsible for any content, links, advertisements, site malfunctions, miss-directions or any other events that may cause harm mentally, physically or to property.
You agree that Splash-Wave.com, in its sole discretion, may terminate your password, account (or any part thereof) or use of the Service, and remove and discard any Content within the Service, for any reason, including, without limitation, for lack of use or if Splash-Wave.com believes that you have violated or acted inconsistently with the letter or intent of this agreement.
Splash-Wave.com may also in its sole discretion and at any time discontinue providing the Service, or any part thereof, with or without notice. You agree that any termination of your access to the Service under any provision of this agreement may be effected without prior notice, and acknowledge and agree that Splash-Wave.com may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or the Service. Further, you agree that Splash-Wave.com shall not be liable to you or any third-party for any termination of your access to the Service. Again, it will be your responsibility to cancel any subscriptions you have with Splash-Wave.com by logging in to your Paypal or Alertpay account and manually cancelling the subscription from your account there.
Dealings with advertisers are done at your own risk and Splash-Wave.com can not be held liable for any advertisers actions.
You agree to maintain a valid email address and your account is only activated once you have verified your email address by clicking a link in an email sent to you. By doing so you are bound to accept email from Splash-Wave.com which will include system messages and marketing information. This is an opt-in service and you can choose to receive emails or not by editing your profile. Any user threatening or reporting Splash-Wave.com for sending spam or UCE or Unsolicited Commercial Email will have their account terminated. Further more all legal costs and compensation will be sought through the courts for any loss of time or reputation.
Splash-Wave.com is an honest marketing business supported by appropriate privacy statements, terms and conditions, user agreements, business practices and an excellent reputation in the trade that it will protect through all means available. This benefits you, your business, and the online promotion and marketing businesses in general.
By continuing to use this site you are bound by this agreement and you agree that you will keep all information provided by this site confidential. You are not allowed to copy or comment or take any action that may devalue the sites service and accept any damages or costs thereof such breach including any agent or company that you may be associated with.
All headers, graphics, logo's, and site name are copyrighted. You may NOT use them without Splash-Wave.com written permission. You are permitted to use the splash pages and banners in the promotion of your referral campaign. Splash-Wave.com links MUST remain intact.
Spam/UCE/
Direct reference of ANY domain owned by Splash-Wave.com in ANY email is STRICTLY PROHIBITED. This includes, but is not limited to, your Splash-Wave.com affiliate URL This is sufficient grounds for immediate Termination of your Account.
Member Statement:
I have thoroughly read and understand the Splash-Wave.com terms and conditions. In joining and/or purchasing a Splash-Wave.com membership I agree to said terms and conditions.
